Debt

Can I consolidate ATO debt into my mortgage?

Some lenders allow equity release to clear tax debt, but the home, loan term and business conduct are central.

Short answer

It may be possible to refinance or increase a mortgage to pay ATO debt when the lender accepts the purpose, the property provides enough equity and the larger loan is serviceable. Policy varies. The lender will usually review the tax balance, payment history, lodged returns, business position and whether new tax obligations are being kept current.

The lower rate is only one part

Mortgage rates may be lower than unsecured or payment-plan costs, but moving tax debt against the home converts it into long-term secured debt. Compare total interest over a controlled repayment period and include refinancing, valuation, discharge and any LMI costs.

  • Obtain a current ATO account statement.
  • Keep payment-plan instalments up to date.
  • Explain why the debt arose and why it will not recur.
  • Use a separate split with a repayment target.

The lender will assess ongoing tax compliance

Clearing an old balance does not solve a business that continues using GST or tax money for cash flow. Current BAS and returns should be lodged, and the post-settlement business budget must cover new obligations as they arise.

How to compare the repayment period

If $40,000 of tax debt could be repaid under a five-year plan, compare the mortgage split over five years rather than simply using the remaining 25 or 30-year home-loan term. The required payment may be higher than the mortgage minimum, but total interest can be much lower. Automate that separate repayment where possible. A reduced monthly commitment is helpful only when the debt is not allowed to remain for decades.

Personal and company tax debts differ

The borrower, company or trust that owes the tax affects documentation, loan purpose and accounting. Borrowing personally to pay a company liability can create a loan or contribution between entities and needs tax and legal advice. Director guarantees or director penalty exposure may also be relevant. Do not transfer funds until the structure and tracing are clear. A lender approval does not determine whether interest is deductible or the payment is treated correctly in the accounts.

Consider alternatives and household risk

Compare the ATO payment plan, business finance, sale of non-essential assets, staged repayment and mortgage consolidation. Each has different cash-flow, interest, security and tax consequences. If the business cannot meet normal tax obligations after consolidation, adding the debt to the home may postpone rather than solve the problem. Obtain accounting advice and prepare a realistic cash-flow plan. If household repayments are already difficult, seek hardship assistance or free financial counselling early.

Questions to ask before you proceed

  • What is the total interest if the consolidated amount is repaid over a shorter target period?
  • Which cleared limits will be reduced or closed so the original debt does not return?
  • What changes when unsecured debt becomes secured against the home?

Key takeaway

Mortgage consolidation can lower the rate, but it needs a short repayment plan and a solution to the cause of the tax debt.
